News-Herald, PUBLIC NOTICE Notice is hereby given that City of Mentor-on-the-Lake’s Charter Review Commission has caused the following ten (10) amendments to the City’s Charter to be placed before the registered voters of the City of Mentor-on-the-Lake. (A majority affirmative vote is necessary for passage of each issue) The General Election will be held on Nov. 4, 2014 from 6:30 a.m. to 7:30 p.m., at the three election polling places within Mentor-on-the-Lake. ISSUE 4 SECTION 4.01 COMPOSITION AND TERMS Seven (7) Council members are to be elected. Three (3) Council members are to be elected at large. Four (4) Council Members shall be elected from wards, one from each ward. The Ward Council Members must be a resident of the Ward on the date they file their petitions for election with the Board of Elections and he or she must also meet the qualifications of Section 4.02 of the Charter. The present Council shall, within 45 days after adoption of this Charter provision, divide the municipality into four (4) wards having as near as practical, equal population, and thereafter the then existing Council shall have the power to change the boundaries of the wards by ordinance every four (4) years thereafter and upon the annexation of any territory, shall have the power to place said district or any part thereof in any existing ward or wards as will most efficiently keep said wards of equal population, Ward council members shall serve for a term of four (4) years beginning on the first day of January next following their election. The initial term of office of the ward council members shall commence on January 1, 2016 and every four (4) years thereafter. At large members of Council shall also serve for a term of four (4) years. In November 2017, and quadrennially thereafter, the at-large councilpersons shall be elected so as to provide that the term of one councilperson at large will commence on the first day of January, 2018 and quadrennially thereafter; the term of one councilperson at large shall commence: on the second day of January, 2018, and quadrennially thereafter; and the term of one councilperson at large shall commence on the third day of January, 2018, and quadrennially thereafter. ISSUE 5 SECTION 4.06 ORGANIZATION Council shall conduct an annual organizational meeting on a date and time determined by Council. In the event the organizational meeting is not held prior to 6:00 p.m. on the second Tuesday of January, then the organizational meeting shall be held at 6:00 p.m. on the second Tuesday of January. At the organizational meeting, the Council shall meet in the Council Chamber for the purpose of organization. The Council shall adopt its own rules, regulations, and/or by-laws except as otherwise provided in this Charter. ISSUE 6 Shall Article VII, Section 7.04, Parks and Recreation Board of the Charter of Mentor on the Lake be repealed so that the City of Mentor on the Lake is not required by its Charter to have a Parks and Recreation Board. ISSUE 7 Shall Article VII, Section 7.07 (C), Civil Service of the Charter of Mentor on the Lake be amended so that part-time police officers are part of the unclassified civil service of the City instead of the classified service and so that the Civil Service Commission may determine that no competitive exam is required for the initial appointment of a part-time firefighter and that no part-time firefighter shall be eligible to take the full-time civil service test or be eligible for a promotion in the part-time ranks unless a part-time firefighter has passed a competitive civil service exam and has then been hired off of a civil service list as a part-time firefighter. ISSUE 8 Shall Article X, Section 10.02, Recall, of the Charter of Mentor on the Lake be amended so that any petition for the recall of an elected officer must be signed by at least that number of electors which equals twenty-five percent (25%) of the total number of registered voters as of January 1 in the year the recall petition is filed in the voting district of the elected officer who is the subject of the recall petition instead of by that number of electors which equals twenty-five percent (25%) of the total number of electors voting at the last preceding November election. ISSUE 9 Shall Article X, Section 10.03, Conflict of Interest, of the Charter of Mentor on the Lake be amended to add language that an elective officer must continue to reside in their election district during his or her term of office so that as amended this Charter provision would read as follows: Each elective officer of the Municipality shall be a qualified elector of the Municipality and shall continue to reside within the Municipality and within their election district during his or her tenure. He or she may hold other public employment provided it is compatible with his or her elective office in the Municipality. In no event, however, shall an elective officer of the Municipality hold public employment with the City of Mentor-on-the-Lake. ISSUE 10 Shall Article XII, Taxation of the Charter of Mentor on the Lake be amended to authorize Council to levy an additional 1.5 mill tax for a period of five years beginning with the tax duplicate for 2014 for the purpose of providing operating and equipment funds for the Mentor on the Lake Police Department so that Article XII of the Charter as amended would include an additional Section that would read as follows: In addition to the levies provided for in this Article XII, commencing with the tax list and duplicate for the year 2014, the Council is hereby granted the authority, without a vote of the people, to levy taxes for a period of five years beginning with the tax list and duplicate for 2014 and ending with the tax list and duplicate for the year 2018 upon the tax lists or duplicates of property assessed and listed for taxation according to value, an amount not in excess of 1.5 mills per dollar of assessed valuation, for the purpose of providing operating funds and equipment funds for the Mentor-on-the-Lake Fire Department. The amount of taxes in each year so levied pursuant to this section shall not be subject to the limitations on the rate of taxation provided in this Charter and shall be in addition to any taxes levied by Council pursuant to any provision of this Charter or the general laws of the State of Ohio. There is hereby established a special revenue fund of the Municipality, to be known as the “Fire Department Operating and Equipment Fund,” into which the proceeds of the tax levied pursuant to this section shall be deposited. Moneys credited to that revenue fund shall be used only for the purposes of operating funds and equipment purchases for the Mentor-on-the-Lake Fire Department. ISSUE 11 Shall Article XII, Taxation of the Charter of Mentor on the Lake be amended to authorize Council to levy an additional 1.1 mill tax for a period of five years beginning with the tax duplicate for 2014 for the purpose of providing operating and equipment funds for the Mentor on the Lake Fire Department so that Article XII of the Charter as amended would include an additional Section that would read as follows: In addition to the levies provided for in this Article XII, commencing with the tax list and duplicate for the year 2014, the Council is hereby granted the authority, without a vote of the people, to levy taxes for a period of five years beginning with the tax list and duplicate for 2014 and ending with the tax list and duplicate for the year 2018 upon the tax lists or duplicates of property assessed and listed for taxation according to value, an amount not in excess of 1.1 mills per dollar of assessed valuation, for the purpose of providing operating funds and equipment funds for the Mentor-on-the-Lake Fire Department. The amount of taxes in each year so levied pursuant to this section shall not be subject to the limitations on the rate of taxation provided in this Charter and shall be in addition to any taxes levied by Council pursuant to any provision of this Charter or the general laws of the State of Ohio. ISSUE 12 Shall Article XII, Taxation of the Charter of Mentor on the Lake be amended to authorize Council to levy an additional 1.2 mill tax for a period of five years beginning with the tax duplicate for 2014 for the purpose of providing funds for the construction and repair of the roads of the City of Mentor on the Lake so that Section XII of the Charter as amended would include an additional Section that would read as follows: In addition to the levies provided for in this Article XII, commencing with the tax list and duplicate for the year 2014, the Council is hereby granted the authority, without a vote of the people, to levy taxes for a period of five years beginning with the tax list and duplicate for 2014 and ending with the tax list and duplicate for the year 2018 upon the tax lists or duplicates of property assessed and listed for taxation according to value, an amount not in excess of 1.2 mills per dollar of assessed valuation, for the purpose of providing funds for the construction and repair of the roads of Mentor-on-the-Lake Roads Department. The amount of taxes in each year so levied pursuant to this section shall not be subject to the limitations on the rate of taxation provided in this Charter and shall be in addition to any taxes levied by Council pursuant to any provision of this Charter or the general laws of the State of Ohio. There is hereby established a special revenue fund of the Municipality, to be known as the “Roads Construction and Repair Fund,” into which the proceeds of the tax levied pursuant to this section shall be deposited. Moneys credited to that revenue fund shall be used only for the purposes of constructing and repairing the roads of the City of Mentor-on-the-Lake. ISSUE 13 Shall Article XII, Taxation of the Charter of Mentor on the Lake be amended to authorize Council to levy an additional 1.1 mill tax for a period of five years beginning with the tax duplicate for 2014 for the purpose of providing funds for the current operating expenses of the City of Mentor on the Lake so that Section XII of the Charter as amended would include an additional Section that would read as follows: In addition to the levies provided for in this Article XII, commencing with the tax list and duplicate for the year 2014, the Council is hereby granted the authority, without a vote of the people, to levy taxes for a period of five years beginning with the tax list and duplicate for 2014 and ending with the tax list and duplicate for the year 2018 upon the tax lists or duplicates of property assessed and listed for taxation according to value, an amount not in excess of 1.1 mills per dollar of assessed valuation, for the purpose of providing funds for the current operating expenses of the City of Mentor-on-the-Lake. The amount of taxes in each year so levied pursuant to this section shall not be subject to the limitations on the rate of taxation provided in this Charter and shall be in addition to any taxes levied by Council pursuant to any provision of this Charter or the general laws of the State of Ohio. There is hereby established a special revenue fund of the Municipality, to be known as the “Current Operating Expense Fund” into which the proceeds of the tax levied pursuant to this section shall be deposited. Moneys credited to that revenue fund shall be used only for the purposes of current operating expenses of the City of Mentor-on-the-Lake. 398960/October 14, 21, 2014
